Terms of Use

Welcome to GeoDe. By installing or using the GeoDe mobile app, the geodesave.com website, or any related services (the “Service”), you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old to use GeoDe. If you're using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The Service

GeoDe surfaces deals at restaurants, cafés, bars, retailers, salons, entertainment venues, and other local businesses, and pings you when you cross within range of an active offer.

Deals are loaded into the platform on a best-effort basis. Some deals are posted directly by merchants through a merchant account. Others are aggregated by us from publicly available sources. We do not guarantee that any deal listed on the Service is current, accurate, complete, or available — pricing, hours, terms, eligibility, and stock are controlled by the merchant and can change at any time without notice. Merchants may add, modify, or pull deals on their own schedule, and merchants always have the final say on whether to honor a deal at the point of redemption.

GeoDe is not responsible for deals that are outdated, inaccurate, withdrawn, modified, or refused at the counter. We make reasonable effort to remove deals we know are no longer valid, but we cannot guarantee the timeliness of any update.

3. Redemptions

You can redeem a deal by showing your screen, scanning a QR code, or tapping to claim, depending on what the merchant supports. The merchant may impose conditions (per-customer limits, hours, exclusions) printed in the deal's details. We don't guarantee that any specific deal will be honored if those conditions aren't met.

4. Acceptable use

• Don't spoof your location or otherwise circumvent the geofence.
• Don't use scripts, scrapers, or bots against the Service.
• Don't resell or transfer redemptions for profit.
• Don't use the Service to harass, defraud, or harm anyone.

We can suspend or remove access if we believe the Service is being misused.

5. For merchants

Merchants who list deals are responsible for honoring the published terms, complying with applicable laws (including consumer protection, food safety, and licensing), and providing accurate information about their business. GeoDe charges a commission on completed redemptions. Specifics will be in your merchant agreement.

6. Notifications and location

Geofence notifications are opt-in. You can disable them at any time in your phone's settings or inside the app. We use low-power location services and do not continuously track your position; see our Privacy Policy for details.

7. Intellectual property

The GeoDe name, logo, and software are owned by GeoDe, Inc. You may use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or reverse-engineer the app except as permitted by applicable law.

8. Disclaimers

The Service is provided “as is.” We do not guarantee that deals will be available, that the app will be uninterrupted or error-free, or that geofence notifications will be delivered every time. Push delivery depends on the operating system, your settings, and your device's battery state. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of liability

To the fullest extent permitted by law, GeoDe will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Service, any deal listed on the Service, any merchant's acts or omissions, the failure of any geofence notification to be delivered, or any reliance placed on information in the app, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if GeoDe has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. In those jurisdictions, GeoDe's liability is limited to the maximum extent permitted by law.

10. Changes

We may update these Terms as the product evolves. The “Last updated” date reflects the current version. Continued use of the Service after changes are posted means you accept them.

11. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law rules. Any dispute that can't be resolved informally will be brought in the courts located in Fulton County, Georgia, and you and we consent to that jurisdiction.
